Use of Website
Your use of the website at www.vitacare-biotechnology.co.nz (Website) and/or the ordering of any product from VitaCare-Biotechnology Limited creates a legally binding contract between you and VitaCare subject to these terms and conditions.
These terms and conditions incorporate any of the information or terms set out on pages on the Website linked to in these terms and conditions.
While VitaCare endeavours to ensure that no viruses or malicious software is contained on the Website, VitaCare makes no warranty as to your use of the Website and VitaCare will have no liability for any damage to your computer or other hardware as a result of your use of the Website.
You may not make use of any logo or trade mark displayed on the Website without the express written consent of VitaCare. You may link to the Website from any other website provided that you agree to immediately remove that link if requested by VitaCare.
Links to 3rd Party Websites
The Website contains links to websites that are not controlled by VitaCare (Third Party Website). VitaCare makes no promises or warranties as to the content or security of any Third Party Website and you link to and use any such Third Party Website at your own risk.
Subject to your rights under the Consumer Guarantees Act 1993, VitaCare will not be liable for any:
> Warranties, conditions and representations whether express, implied, statutory or otherwise, relating in any way to the Website, your use of the Website and the information, products supplied, offered to be supplied or advertised or accessed through the Website; and
> Liability (including for negligence) to you or anyone else in respect of any loss or damage (including special, indirect or consequential loss or damage), costs and expenses suffered by you or claims made against you arising from or in connection with your use of the Website and the information, products supplied, offered to be supplied or advertised or accessed through this Website for any reason whatsoever (including negligence).
VitaCare’s maximum aggregate liability for any product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount paid by you to VitaCare in respect of the product excluding any amount paid for delivery.
You agree that if any product has been acquired for the purposes of a business, the provisions of the Consumer Guarantees Act 1993 are excluded in relation to those products.
All products ordered by you are supplied on an “as is, where is” basis and VitaCare makes no warranty as to the suitability or efficacy of any product beyond any manufacturer warranty included with the product.
No information on the Website is intended to be taken as medical advice and is intended only for information purposes. Always read the label of any product carefully and use only as directed. If your symptoms persist or you are uncertain as to whether any product may be safe for your use, consult a health professional. If you have a pre-existing medical condition, are pregnant or lactating, consult a health professional prior to using any product.
Some products supplied to you will include an expiry date which will vary depending on the product. It is VitaCare’s policy not to dispatch any product that is within three months of its expiry date, unless otherwise stated on it’s product page.
The use of the Website and the ordering of any product by you from VitaCare is subject to the laws of New Zealand. You agree to submit to the exclusive jurisdiction of the courts of New Zealand in relation to any dispute between you and VitaCare.
Terms of Sale
Orders may be cancelled and products may be returned in accordance with VitaCare return and cancellation policy.
VitaCare will endeavour to deliver all orders made by you on the Website but reserves the right to refuse to deliver any products ordered for any reason, including without limitation, unavailability of stock or a decision by VitaCare to no longer sell a product.
All prices for products are exclusive of GST. Sales to customers outside of New Zealand will be exempt from the payment of GST but may be subject to the payment of taxes and charges in their country.
Direct Credit / Internet Banking
Please pay directly into our account – your order will be sent once the payment has cleared. Please make payment within 24 hours of ordering to prevent your order being cancelled.

All New Zealand orders are sent overnight delivery with Courier TBC. If ordered before 4pm on a business day, your order should arrive the next business day.
While we make our best efforts, we can not guarantee overnight delivery if there are delays with Courier TBC. It may also take a little longer for addresses in rural areas.
When you pay by Internet Banking, we need to wait for the payment to show in our account before processing the order for the courier pick up.
All NZ parcels are sent overnight with Courier TBC.
All orders are sent in Track & Trace Trackpaks. We will email your number and a link to you as soon as your order is packed. Please note that clicking on the tracking link may not work for a few hours – the tracking number is only recorded with Courier TBC once they have picked up your parcel from VitaCare.
NZ Signature Required
Orders sent using flat rate are sent using ‘No Signature’ required Trackpaks. You may pay an extra $3 to have ‘Signature Required’. If you qualify for Free Shipping and would like ‘Signature Required’, please leave a note in the delivery instructions and we’ll include it for free.
Non-Signature parcels are sent at the buyers risk, so please make sure that your Courier has a safe place to leave your parcel if you will not be at the clinic (or office, home, etc.) to receive it. Neither VitaCare nor Courier TBC are liable for parcels that have been stolen or items were damaged due to weather conditions (e.g. exposed to the direct sun or heat).
NZ P.O. Boxes
We deliver to P.O Boxes at no additional charge. If your order is too big for your P.O Box, Courier TBC will hold it behind the counter for you.
NZ Rural Addresses
Yes, we deliver to rural addresses for an additional $3.
Australian orders are sent either through Courier TBC. While an untracked option is available, we are unable to replace parcels that go missing using this option. We highly recommend the ‘tracked’ shipping option. Untracked Australian orders generally take up to 14 days to arrive.
Missing or damaged parcels
If your goods don’t reach you in perfect condition please notify us as soon as possible. Please don’t return damaged goods without notifying us first, as it is sometimes preferable to make arrangements from our end. Please keep any packaging and damaged items as they are received, as these are required for the claim process.
In the unlikely event that your parcel doesn’t reach you within the expected delivery time-frame (NZ = 3 working days / international = 21 working days max – see table above) of our having emailed you confirmation of dispatch, please let us know.
Courier TBC terms and conditions dictate that an international investigation into a missing or damaged parcel can only be launched within a limited time after a parcel’s dispatch.
> For us to be able to assist you with regards to a missing parcel please contact us within 90 days of your parcel’s dispatch.
> For us to be able to assist you with regards to a damaged parcel please contact us within 7 days of your parcel’s delivery date.
After these times we will unfortunately be unable to assist you.
We’ll do our absolute best to get your NZ order to you overnight but can not guarantee overnight delivery. There may be complications with your order or with the Courier in your area, contact us if you have problems and we’ll do our best to help.
On occasion, items may be stolen or go missing. We do our best to track them down but we can’t control what happens once your parcel leaves the VitaCare office. To be safe, we recommend the ‘Signature Required’ option.
If your parcel is returned to us for whatever reason, we will need to charge a fee to send it again. Please check that there is a safe place for the Courier to leave your parcel and that the address you have provided is correct. If you have chosen ‘Signature Required’, please make sure that you answer any Card To Call requests from Courier TBC in a timely manner to avoid parcels being returned.
Returns & Exchanges
We want to you love everything you buy from VitaCare so please do not hesitate to contact us with any problems.
If your item arrives broken or faulty, please contact us within 10 days of purchase. We will offer the option of a full refund or replacement if the item has arrived faulty. Unfortunately we can not guarantee a refund of the cost of posting your items back to us but may offer this at our discretion.
Please choose your items carefully as we can not offer refunds or replacements due to ‘change of mind’ purchases, only in the instance where the item has arrived broken or faulty.
Please keep all original packaging if there is an issue with your order. If you receive an incorrect item, please do not open or use it, we can not process returns on used items.
If you wish to cancel an order before it is shipped, please email or phone us. If we are able to catch it in time, we will issue a store credit for the value of the order. Unfortunately orders that are already with the Courier can not be cancelled. Please think carefully before placing your order, we work really hard to get all orders out with overnight delivery so often it’s hard to locate an order before it’s with the Courier.
Please note also that colours shown are an indication only and often appear different between different computers & phones. Please let us know if you think an image or swatch is inaccurate.
Routine Information Collection
All web servers track basic information about their visitors. This information includes, but is not limited to, IP addresses, browser details, timestamps and referring pages. None of this information can personally identify specific visitors to this site. The information is tracked for routine administration and maintenance purposes.

Terms of Registration / Purchase
When you register on VitaCare you agree to have your name, email, telephone number and delivery address added to our database. You can unsubscribe from our emails at any time. When you place an order, you agree to allow your postal information to be passed to Courier Post for the purposes of fulfilling your order. We may also pass on your phone number on odd occasions where we feel it could help your Courier deliver your parcel safely.
We may occasionally request additional information from you such as a copy of your ID. This is so that we can investigate payments that have been flagged as suspicious. You may decline this request but we reserve the right to cancel your order if we don’t feel sure that the payment was legitimate.
